  3. Drivers

    Private Hire Driver

Section 54(2) of the LG(MP)A 1976 states the following:

    (a) A driver shall at all times when acting in accordance with the driver’s licence granted to him wear such badge in such position and manner as to be plainly and distinctly visible.

    (b) If any person without reasonable excuse contravenes the provisions of this subsection, he shall be guilty of an offence.

If driving an exempted vehicle under section 75(3) of the LG(MP)A 1976 then it is not a requirement for the driver to wear his badge, however, it is strongly advised that the badge is kept in the possession of the driver in order to enable a Police Officer or other duly Authorised Officer to verify that the driver is licensed to undertake private hire work.

    Hackney Carriage Driver

Section 13 of Chichester District Council’s Hackney Carriage Byelaws states the following:

If a badge has been provided by the Council and delivered to the driver of a hackney carriage he shall, when standing or plying for hire, and when hired, wear that badge in such position and manner as to be plainly visible.

  4. Vehicles

    Private Hire Vehicle

Under Section 48 of the LG(MP)A1976, the following sub-sections apply:

    (5) Where a district council grant under this section a vehicle licence in respect of a private hire vehicle they shall issue a plate or disc identifying that vehicle as a private hire vehicle in respect of which a vehicle licence has been granted.

    (6)

    (a) Subject to the provisions of this Part of this Act, no person shall use or permit to be used in a controlled district as a private hire vehicle in respect of which a licence has been granted under this section unless the plate or disc issued in accordance with subsection (5) of this section is exhibited on the vehicle in such manner as the district council shall prescribe by condition attached to the grant of the licence.

    (b) If any person without reasonable excuse contravenes the provisions of this subsection he shall be guilty of an offence.

Condition 7(4) of Chichester District Council’s Private Hire Vehicle Licence Conditions state:

Where a private hire vehicle is used for ‘mainstream’ short haul private hire work, in addition to the licence plate, private hire vehicle owners/operators will be required to affix a sign on both rear doors indicating that the vehicle has to be ‘pre-booked’. The additional doorplates shall include the Council’s logo and the vehicle licence number.

    Hackney Carriage Vehicle

Section 2(a) of Chichester District Council’s Hackney Carriage Byelaws state the following:

The Proprietor of a Hackney Carriage shall cause the number of the licence granted to him in respect of the carriage to be legibly painted or marked on the outside and inside of the carriage, or on plates affixed thereto.
