Pollution

We can offer assistance if you suffer domestic or commercial nuisance from your neighbours, including:

• accumulation or deposits;
• dust;
• noise;
• poorly maintained drainage;
• smell;
• smoke, and;
• the keeping of animals

Evidence of nuisance has to be obtained. You are asked to complete a 14-day diary record to demonstrate exactly what the problem is, how often it occurs and what effect it is having. Our Environmental Management team will then assess the diary to determine whether there is a need for further investigation. This is done by officers witnessing the problem through the use of monitoring equipment. If the evidence is insufficient to support formal action or the problem is intermittent, you may be advised to take your own action in the magistrate's court under Section 82 of the Environmental Protection Act 1990.
